Terms of Service
These Terms of Service (“Terms”) govern your use of SantaPet at https://xmaspet.com. SantaPet is an indie web tool that generates AI Christmas costume-style images from pet photos you upload. By using the site you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the service.
The operator is an individual seller (Zhang Mingzhe). No company registration number is claimed.
1. The service
- Free watermarked previews generated with AI (currently Cloudflare Workers AI), subject to rate limits and daily caps.
- Optional one-time unlock (about USD $1.99) for a watermark-free PNG download of a generated result, paid via Creem checkout.
- A browser overlay fallback may appear if AI generation is unavailable; quality and style are not guaranteed.
Features, pricing, caps, and providers may change. We may suspend or discontinue the service with reasonable notice when practical.
2. You are responsible for uploaded content
You alone are responsible for every photo and file you upload and for how you use any output.
By uploading, you represent and warrant that: (a) you own the photo or have all rights, licenses, and permissions needed to upload it and authorize our processing; (b) the upload does not infringe copyright, trademark, publicity, privacy, or other rights of any person or brand; (c) the upload does not depict minors in any sexual, exploitative, or otherwise prohibited way, and complies with our Acceptable Use Policy; (d) you will not upload images you do not have the right to use (including other people’s pets or photos scraped without permission when rights are required).
You grant SantaPet and its infrastructure providers a limited, non-exclusive, worldwide license to host, transmit, process, and temporarily store your uploads solely to provide the generation, preview, unlock, and support features you request — not for unrelated advertising. This license ends when the temporary copies we control are deleted or expire, except for copies retained as required by law or payment disputes.
You agree to indemnify and hold harmless the operator from claims arising from your uploads, your use of outputs, or your breach of these Terms, to the extent permitted by applicable law.
3. AI outputs — no guarantees
Outputs are produced by automated models. They may be inaccurate, distorted, unexpected, or unsuitable. We do not warrant that outputs are unique, error-free, commercially usable for every purpose, or free of third-party IP claims. You are responsible for reviewing outputs before sharing, printing, or commercial use. SantaPet is not affiliated with any trademarked “Santa,” holiday brand, film studio, or pet brand.
4. Purchases and unlocks
Paid unlocks are processed by Creem as merchant of record. Checkout is subject to Creem’s terms and payment methods. After successful payment verification, you may download a clean PNG for the associated generation while the file remains available (temporary retention — download promptly). Unlock is for the specific generation/session indicated at checkout, not an unlimited subscription unless we clearly offer otherwise.
5. Refund policy
Digital goods are generally non-refundable once unlocked or downloaded.
Because the product is a digital image delivery, we do not offer refunds merely because you changed your mind, disliked the artistic result, chose the wrong style, or already obtained the clean download.
Exceptions: If payment succeeded but we failed to deliver the unlock (for example verified payment with no downloadable file due to a technical failure on our side), or a clear double charge occurred, email [email protected] within 14 days of the charge. Include your checkout/order id, approximate time, and a short description. We will investigate and, where the failure is confirmed, provide a re-delivery or refund through Creem as appropriate.
Card network chargebacks for buyer’s remorse after a successful download may lead to loss of unlock access and abuse prevention measures.
6. Acceptable use
You must follow the Acceptable Use Policy. We may refuse generation, remove content we still control, block access, or cancel unlocks for violations without refund when misuse is involved.
7. Intellectual property
The SantaPet name, site design, and our original text/code belong to the operator or licensors. Sample gallery images are illustrative. Subject to these Terms and third-party rights, you may use outputs you legitimately generate for personal non-commercial holiday sharing; commercial use is at your own risk regarding likeness, trademarks, and model-output rules.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC UNLOCK GIVING RISE TO THE CLAIM IN THE 90 DAYS BEFORE THE CLAIM, OR (B) USD $20. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. Some jurisdictions do not allow certain limits; in those cases our liability is limited to the fullest extent allowed.
10. Governing law
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules. Courts in Shenzhen, Guangdong, China shall have non-exclusive jurisdiction, unless mandatory consumer protections in your country provide otherwise.

12. Changes
